Harwood Savin advised the former K College (now Ashford College) on the renewal of outline planning permission for up to 241 residential units on the College’s existing campus, which helped to facilitate the development of the College’s new campus in Ashford Town Centre at Elwick Road.
From the outset we advised on the most timely and cost effective planning strategy and the form and content of the renewal application submission. Following submission it was critical to ensure that the application was considered quickly and in parallel with the College’s Elwick Road proposals, where we were responsible for leading negotiations with the Council. We were successful in the co-ordination and delivery of a comprehensive viability exercise and exceptional needs case to minimize S106 contributions including those in respect of affordable housing, resulting in a reduction in S106 contributions from circa £2m to circa £500,000 and affordable housing from 30% to 10%. This had a significant impact upon the overall viability of the proposals and the ability of the College to cross fund the new state of the art proposals at Elwick Road.
Following a resolution to grant planning permission, Harwood Savin worked closely with the College’s solicitors in the Section 106 negotiations and provided ongoing advice in respect of planning conditions. The site was subsequent sold with the benefit of outline planning permission and has been built out by Chartway Group and Orbit Homes.
